Child Pornography

Child pornography is illegal under Federal and all state laws.  The United States Supreme Court has ruled that such material is “legally obscene,” and not protected by the First Amendment.  Federal sentencing guidelines differentiate between producing, distributing, purchasing and receiving such material, with more severe penalties determined by the age of the child, especially if under the age of 12.  A distinction is also made based on whether the images involved are of an actual minor, versus realistic images or drawings of a minor.  In the case of realistic images and drawings, the Law specifies that these only are under the protection of the First Amendment unless found to be obscene in nature.
