Types of Credit Card Fraud

Credit card fraud can encompass a number of offenses, all of which revolve around the unauthorized use of credit cards or credit card account numbers. These include:

  • Credit Card Theft:  This occurs when a credit card, or credit card number, is obtained via illegal means. Until the theft is detected and the credit card canceled, the account number may be used physically, online, or over-the phone to make unauthorized purchases.
  • Identity Theft:  This occurs when an individual’s social security number and other identifying information is used without their knowledge or consent to open credit cards or obtain loans in their name. Identity theft charges may also be levied if an offender hijacks another identity in order to utilize credit card accounts already established in that person’s name.
  • Skimming: With the advent of the ATM, credit card skimming became very prevalent. This type of credit card fraud involves the theft of information from a credit card during a legitimate transaction via the installation of a “skimmer” on an ATM.

Other acts that can also be prosecuted under New York and federal credit card fraud laws include:

  • Using the U.S. mail to obtain a fraudulent credit card
  • The distribution or manufacture of fraudulent credit cards
  • Using fraudulent information on a credit application
  • Fraudulently obtaining credit card information via a website created for that purpose.
